Introduction

Welcome to The Marketing Manager. These Terms and Conditions ("Terms") govern your use of our website and the marketing services we provide. By engaging our services or using our website, you agree to these Terms.

The Marketing Manager ("we," "us," or "our") provides fractional marketing support, consulting, and related services to Canadian service businesses.

Services

 

​Service Offerings

We offer various marketing services including but not limited to:

  • Marketing Audits

  • Strategy Sessions

  • Hourly Consulting

  • Marketing Plan & Setup

  • Ongoing Marketing Support

All services are customized based on client needs and confirmed via email or invoice before work begins.

 

Service Scope

The specific scope of work, deliverables, timeline, and pricing for each engagement will be outlined in a separate proposal, invoice, or service agreement. Work will only begin once payment has been received and scope has been confirmed in writing.

 

Scope Changes

If the scope of work needs to change during an engagement, we will communicate the additional costs via email. Work on any scope changes will not begin until:

  • Written approval is received via email, OR

  • Payment for the additional work has been received

 

Payment Terms

Payment Requirements

  • All services require payment upfront before work begins

  • Payment must be received in full before any work commences

  • Accepted payment methods will be specified on your invoice

 

Late or Non-Payment

  • If payment is not received, work will not start

  • For ongoing monthly services, failure to pay by the agreed-upon date may result in service suspension until payment is received

 

No Refunds

  • All services are non-refundable

  • If you choose to cancel a service, you are responsible for paying for work completed up to the cancellation date

  • You will receive any deliverables or work completed up to that point

Cancellation Policy​

 

One-Time Services

For one-time services (Marketing Audits, Strategy Sessions, Hourly Consulting, Marketing Plan & Setup):

  • No refunds are provided once payment is made and work has begun

  • You will receive all work completed up to the cancellation date

 

Ongoing Services

For ongoing monthly services (Ongoing Marketing Support):

  • Services operate on a month-to-month basis with no long-term contracts

  • You may cancel at any time by providing reasonable written notice via email

  • You must complete and pay for the current billing period already paid for

  • No refunds will be provided for partial months

 

Client Responsibilities

To ensure successful delivery of services, clients are responsible for:

  • Providing timely access to necessary information, accounts, and materials

  • Responding to questions and requests for feedback within a reasonable timeframe

  • Reviewing and approving deliverables in a timely manner

  • Implementing recommended strategies and tactics (where applicable)

Delays caused by lack of client responsiveness may result in project timeline extensions.

 

Intellectual Property

 

Ownership of Work Product

  • All marketing materials, strategies, plans, and deliverables created specifically for you become your property upon full payment

  • We retain no ownership rights to custom work created for your business

 

Portfolio and Marketing Use

  • We may showcase work created for you in our portfolio, case studies, or marketing materials only with your explicit written permission

  • We will not share confidential business information or proprietary strategies without permission

  • You may revoke permission for us to showcase your work at any time by notifying us in writing

 

Pre-Existing Materials

  • We retain all rights to our methodologies, frameworks, templates, and processes used in delivering services

  • Any tools, templates, or resources we provide remain our intellectual property but you may use them for your business

 

Confidentiality

 

Our Commitment

  • We treat all client information as confidential unless it is publicly available

  • We will not disclose your business information, strategies, or data to third parties without your consent

  • Exception: Information may be used internally for service delivery and with your permission for marketing purposes (case studies, testimonials, portfolio)

 

Non-Disclosure Agreements (NDAs)

  • We are willing to sign mutual Non-Disclosure Agreements upon request

  • All NDAs must be reviewed by our legal counsel before signing

  • Please allow reasonable time for NDA review

 

Client Confidentiality

  • Clients agree to keep our proprietary methodologies, frameworks, and processes confidential

 

 

Limitation of Liability

 

Scope of Responsibility

The Marketing Manager is responsible only for the work explicitly outlined in your invoice or service agreement. We are not responsible for:

  • Marketing results or outcomes (leads, sales, revenue, etc.)

  • Changes to third-party platforms (social media, advertising platforms, email providers, etc.)

  • Client implementation of recommendations or strategies

  • Actions taken by client's team members, contractors, or other service providers

  • Technical issues with client's website, hosting, or other systems not under our direct control

 

Maximum Liability

Our maximum liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service in question.

 

No Guarantees

We do not guarantee specific marketing results, rankings, traffic, leads, or sales. Marketing involves testing, optimization, and factors outside our control.

 

 

Communication and Support

 

Response Time

  • We aim to respond to all client emails within 24 business hours (Monday-Friday, excluding Canadian holidays)

  • Urgent matters will be prioritized when possible

  • Response times may vary during periods of high volume or scheduled time off

 

Primary Contact Method

  • All official communications should be sent to: hello@themarketingmanager.ca

  • Important requests, approvals, and scope changes must be communicated via email for documentation purposes

 

 

Third-Party Services

We may recommend or utilize third-party tools, platforms, or services (such as email marketing software, analytics tools, or advertising platforms) to deliver our services.

  • You are responsible for any costs associated with third-party services

  • We are not responsible for third-party service performance, availability, or policy changes

  • You are responsible for compliance with third-party terms of service

 

 

Termination

 

By Client

You may terminate services at any time by providing written notice. You remain responsible for:

  • All work completed up to the termination date

  • The current billing period if already paid

 

By The Marketing Manager

We reserve the right to terminate services if:

  • Payment is not received as agreed

  • Client repeatedly fails to provide necessary information or cooperation

  • Client engages in abusive, threatening, or inappropriate behavior

  • We determine we cannot deliver the agreed-upon services effectively

In the event we terminate services, you will receive all completed work up to that point.

 

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.

  • Continued use of our services after changes constitutes acceptance of the new Terms

  • For active ongoing clients, we will provide notice of material changes via email

  • Changes will not affect services already under contract unless mutually agreed

 

Governing Law

These Terms are governed by the laws of [Your Province], Canada, without regard to conflict of law principles.

Any disputes arising from these Terms or our services shall be resolved in the courts of [Your Province], Canada.

 

General Provisions

 

Entire Agreement

These Terms, together with any service agreements or invoices, constitute the entire agreement between you and The Marketing Manager.

 

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

 

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

 

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.
